These Terms and Conditions ("Terms") govern access to and use of the Dash Credit website located at www.dashcredit.com (the "Website"). The Website is owned and operated by Warm Lodge, Inc. d/b/a Dash Credit ("Dash Credit," "we," "us," or "our"), an entity owned by the Mandan, Hidatsa and Arikara Nation ("MHA Nation"). By accessing or using this Website, you acknowledge that you have read, understand, and agree to be bound by these Terms. If you do not agree to these Terms, you should discontinue use of the Website.

1. ELIGIBILITY

This Website is intended for use by individuals who are at least eighteen (18) years of age and otherwise capable of entering into legally binding agreements. Use of the Website does not guarantee eligibility for any loan or financial product. Any credit products offered through Dash Credit are subject to underwriting criteria, verification requirements, and other eligibility standards.

2. PRODUCTS AND SERVICES

Dash Credit provides information regarding consumer lending products and related services. Information presented on the Website is for informational purposes only and does not constitute a commitment to lend, an offer of credit, or a guarantee of loan approval. All applications are subject to review and approval based on applicable underwriting requirements and program guidelines. Any credit products offered through Dash Credit are subject to separate Lending Disclosures, Truth in Lending Act (Regulation Z) disclosures, Equal Credit Opportunity Act (ECOA) notices, and other required disclosures, which will be provided at application or loan origination. Those disclosures form part of your binding agreement with Dash Credit and supersede any conflicting language in these Website Terms.

4. ELECTRONIC COMMUNICATIONS

Verification requests and customer service inquiries
Account servicing, payment reminders, and fraud prevention
Collections activities where permitted by law
Marketing communications where permitted by applicable law

You may opt out of text messages by replying STOP. For assistance, reply HELP. Message and data rates may apply and message frequency may vary.

5A. PRIOR EXPRESS WRITTEN CONSENT

By providing your telephone number and agreeing to these Terms, you grant prior express written consent for Dash Credit and its agents to contact you regarding loan applications, account servicing, payments, verification requests, fraud prevention, customer service, collections activities where permitted by law, and other business purposes. This consent is in accordance with 47 U.S.C. § 227(b)(1)(A) and the laws of the MHA Nation.

You may revoke this consent in writing at any time by contacting Dash Credit at info@dashcredit.com. Revocation will not affect the legality of calls or texts made before we receive your revocation notice.

5B. SMS TERMS AND SHORT CODE

Dash Credit may send SMS text messages to mobile numbers you provide regarding:

Loan applications and account status
Payments and payment reminders
Customer service communications
Fraud prevention and account security

By providing your mobile phone number, you consent to receive these SMS messages. Standard message and data rates may apply as assessed by your wireless carrier. You are responsible for monitoring your mobile phone usage.

To manage SMS communications:

Reply STOP to any SMS message to opt out. Dash Credit will confirm your opt-out and cease sending SMS messages to your number, except for legally required notices.
Reply HELP for assistance with SMS-related questions.
Contact Dash Credit at info@dashcredit.com with any questions about SMS communications.

SMS messages are governed by the short code provider's terms and Dash Credit's privacy practices.

6. PRIVACY

7. USER RESPONSIBILITIES

11. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Dash Credit and the MHA Nation shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of the Website.

12. TRIBAL SOVEREIGNTY AND GOVERNING AUTHORITY

Dash Credit operates under the authority of the MHA Nation. Dash Credit expressly asserts and relies upon the inherent sovereignty and governing authority of the MHA Nation. These Terms are entered into subject to the MHA Nation's inherent sovereignty, and neither Dash Credit nor the MHA Nation waives any rights, privileges, protections, defenses, immunities, or sovereign authority. All disputes arising from the Website or any Dash Credit product shall be subject to MHA Nation law and the jurisdiction of MHA Nation courts, and the MHA Nation retains full sovereign immunity from suit except to the extent it expressly consents.

13. GOVERNING LAW AND ARBITRATION

These Terms and any loan agreement, product terms, or other agreement between you and Dash Credit shall be governed by and construed in accordance with the laws of the MHA Nation, without regard to its conflict of laws principles.

By accessing or using this Website or applying for a Dash Credit product, you consent to the jurisdiction of the MHA Nation. Except for disputes involving debt collection, which shall be resolved exclusively in MHA Nation courts, any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or any Dash Credit product or service shall be resolved through binding arbitration administered by NAM (National Arbitration and Mediation) in accordance with the following expedited procedures:

The arbitration shall be conducted by a single neutral arbitrator selected in accordance with NAM's rules.
The arbitration hearing shall commence within ninety (90) days of the initiation of the arbitration, unless extended by written agreement of the parties.
Discovery shall be limited to matters relevant to the dispute. Each party may conduct up to ten (10) written interrogatories and five (5) requests for production of documents.
The arbitrator shall issue a written award within thirty (30) days of the conclusion of the hearing.
The parties shall equally split NAM's administrative fees; each party shall bear its own attorney's fees and costs, except that the arbitrator may award attorney's fees and costs as permitted by applicable law.
The arbitration shall be conducted in a location agreed upon by the parties or as determined by NAM.

14. MODIFICATIONS TO THESE TERMS

Dash Credit reserves the right to modify these Terms at any time. Continued use of the Website after revisions are posted constitutes acceptance of the updated Terms.
